During tough economic times, the use of independent contractors increases. Employees may get laid off and the company may realize that they cut too deep. As a result, the ex-employees may be brought back – and paid as - independent contractors. But are they truly bona fide independent contractors?
Employment tax agencies, the IRS, Workers Compensation, and state labor codes are all concerned with whether or not a worker has been misclassified, so the IRS and many states have disclosed that this will be an area of focus during their audits.
Independent contractors may be a necessary, strategic component to your business. If that is the case, you need to know the rules regarding what makes a worker an independent contractor versus an employee.

About Your Speaker
Mindy Harada, CPP, is an employment tax specialist who has over 17 years of employment tax experience as an independent consultant, an employee with one of the Big 4 firms, and as a payroll tax auditor. Ms. Harada previously was the west coast practice leader for the Employment Tax Practice at Deloitte Tax LLP.
Ms. Harada is a frequent presenter on various employment tax topics at APA events and for several payroll service providers on a national basis. She has presented before the Society of CPAs and has also spoken at several Payroll Conferences throughout the country.
