The military leave rules under the Family and Medical Leave Act (FMLA) are changing – again.
In late October, President Obama signed a law that re-writes the family military leave provisions of FMLA that went into effect earlier this year:- The new law gives your employees the right to family military leave for any “exigency” that happens when a relative is called into service outside the United States. (The previous rules applied only to reservists and National Guard members, not active-duty personnel.)
- It also expands the FMLA’s caregiver leave provisions to include not only active military service members, but also veterans.
Confused? It gets worse. These changes took effect on Oct. 28, but existing FMLA regs and certification forms haven’t been updated yet - leaving employers in the dark about the exact steps they should take to comply.

About Your Speaker:
Kristine E. Kwong, Esq. is a partner in the Los Angeles office of the national law firm Hinshaw & Culbertson, LLP. She advises and counsels clients on a wide range of business and employment issues, including disability claims and accommodations, wage and hour matters, non-compete and restrictive covenant agreements, executive compensation packages, and other legal concerns for employers. In addition, her practice includes the drafting and updating of handbooks, policy manuals, codes of conduct, and severance packages, and she regularly produces and presents training programs for employers on current issues of employment law. Kwong earned her law degree from the University of the Pacific (McGeorge School of Law).
